Terms of Use

Welcome to TrackEat. These Terms of Use (“Terms”) govern your access to and use of the TrackEat app and related services (“TrackEat”). By creating an account or using TrackEat, you agree to these Terms. If you do not agree, please do not use TrackEat.

Eligibility

You must be at least 13 years old to use TrackEat. By using TrackEat, you confirm that you meet this requirement and that you are able to enter into a binding agreement with us.

Your Account

You are responsible for the information you provide and for keeping your account credentials secure. You are responsible for all activity that happens under your account. Notify us promptly if you believe your account has been accessed without authorization.

Subscriptions and Payments

TrackEat is free to start, and some features require a paid subscription (“Pro”). Subscriptions are sold through Apple and billed to your Apple ID. Unless cancelled, subscriptions renew automatically at the end of each period, and your Apple ID is charged for the renewal. You can manage or cancel a subscription in your Apple ID subscription settings. Payments are handled by Apple under Apple’s terms; we do not receive or store your full payment card details.

Acceptable Use

You agree to use TrackEat only for lawful, personal, non-commercial purposes. You agree not to misuse the service, including by attempting to access it in unauthorized ways, interfering with its operation, reverse engineering it, uploading harmful or unlawful content, or using it to infringe the rights of others.

Nutrition Information and AI Features

TrackEat provides calorie, macro, barcode, and AI-based food recognition features to help you estimate the nutritional content of foods. These results are estimates and may be inaccurate or incomplete. You are responsible for verifying nutrition information before relying on it. AI recognition and portion estimates are provided for convenience and are not guaranteed to be correct.

Not Medical or Dietary Advice

TrackEat is a tracking tool, not a medical device or a source of professional advice. It does not provide medical, nutritional, or dietary advice, diagnosis, or treatment. Calorie and macro targets are general estimates. Consult a qualified healthcare professional before making decisions about your diet, health, or any medical condition, and do not disregard professional advice because of anything in TrackEat.

Your Content

You retain ownership of the content you add to TrackEat, such as food logs, weight logs, custom foods, and photos. You grant us a limited license to store, process, and display this content solely to operate and improve TrackEat and to provide the features you use, including sending photos to our AI provider for recognition. You are responsible for the content you provide and confirm you have the right to provide it.

Intellectual Property

TrackEat, including its software, design, logos, and the content we provide, is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use TrackEat for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works from TrackEat except as permitted by law.

Third-Party Services

TrackEat relies on third-party services, including Apple, Google, and Open Food Facts. Your use of those services may be subject to their own terms. We are not responsible for third-party services or content, and their inclusion does not imply endorsement.

Termination

You can stop using TrackEat and delete your account at any time from the app. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect TrackEat and its users. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, and limitation of liability — will continue to apply.

Disclaimers

TrackEat is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that TrackEat will be uninterrupted or error-free, or that any information it provides is accurate or complete.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or health outcomes, arising from your use of or inability to use TrackEat. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

Changes to TrackEat and These Terms

We may update TrackEat and these Terms from time to time. If we make material changes to these Terms, we will update the effective date and, when appropriate, notify you in the app or by other reasonable means. Your continued use of TrackEat after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by applicable law, without regard to conflict-of-laws principles. Nothing in these Terms limits any rights you may have that cannot be limited under the law of your country of residence.
